Violation: Sediment-laden water leaving the well site; a state inspector found a failure to implement erosion and sedimentation control best management practices by not properly lining channels, collectors and diversion ditches with either permanent vegetation, rock, geotextile or other non-erosive material, which allowed sediment to leave the well site and flow into the Cross Creek high quality watershed; a month after the inspection the company still had not corrected the problem.
Response: Company said initially it wouldn't be able to correct the problem immediately because of weather conditions, but it eventually lined traps and channels with rock and properly installed other erosion and sedimentation controls.

Violation: Spill; an environmental inspector for the company was on site and noticed that there was a spill on the site; about 2,982 gallons of hydraulic fracturing flowback fluids spilled from a storage tank on the well site and overfilled the secondary containment area near the tank and flowed onto the well pad; it took the company about four hours to report the spill to the state, in violation of state law that requires spills to be reported within two hours of discovery.
Response: Company determined that a butterfly valve on the storage tank was bumped and slightly cracked open, allowing the fluid to leak from the tank; the company vacuumed up the fluid on the site that it could and excavated the impacted soil and disposed of it in a landfill and then backfilled the site with clean fill; company said it took four hours to report the spill to the state because it first wanted to determine if the fluid was freshwater or production fluids; company said it would call first before determining the makeup of what spilled in the future; also, the company said it would make it easier for employees to find emergency response numbers on site.
