Violation: Failure to obtain state authorization prior to constructing a stream crossing; also, failure to properly include all the necessary requirements in the onsite erosion and sedimentation control plan, including showing the site's topography, proposed alterations to the site, and showing all neccessary erosion and sedimentation best management practice controls on a site; also, failure to implement erosion and sedimentation controls along the culvert where a 36 inch culvert was being installed.
Response: Company said it thought the permit had been issued, but it was not issued until 5/1/2008, the day after the inspection; company updated its onsite erosion and sedimentation control plan; it also installed a new silt fence with hay bales to reinforce it at low points.
